Can Promoter sue Buyer?

Can Promoter file complaint against errant Buyer to MahaRERA/RERA Authority?



RERA works both ways, for both Buyer & Promoter as well. If the Buyer violates the terms of the registered agreement say, Buyer is not paying the remaining consideration, the Promoter can pray before MahaRERA for the remedy.



But if no agreement is registered, then it will be governed by the terms of the allotment letter.



If there exist neither registered agreement nor allotment letter, but a Memorandum of Understanding (MoU) then MahaRERA may not come to the rescue.



Bottom line, the Promoter can seek a remedy before MahaRERA from an errant Buyer, while fulfilling his duties.
